Documents to Bring
The trustee will verify your identity and review key financial documents. Bring originals when possible.
- Government-issued photo ID (driver's license, state ID, or passport)Must not be expired. The trustee will compare your photo to your appearance.
- Proof of Social Security numberSSN card, W-2, SSA-1099, or pay stub showing full SSN. Some courts accept last-4 proof.
- Two most recent federal tax returns (all pages)Must be provided to the trustee at least 7 days before the meeting. Failure to provide can result in dismissal under 11 U.S.C. section 521(e)(2).
- Six months of pay stubs or proof of income
- Six months of bank statements (all accounts)
- Copy of your bankruptcy petition, schedules, and SOFAReview every page. The trustee will ask if you reviewed them and if they are accurate.
- Vehicle titles or registration
- Most recent mortgage statement
- Any documents the trustee specifically requestedCheck your mail and your attorney's communications. The trustee may have sent a specific document request.
- Pen (to sign documents or note amendments)
Questions the Trustee Will Ask
Prepare short, direct answers for these standard questions. You are under oath -- answer truthfully.
- "Did you review your petition and schedules before signing?"Answer: "Yes, I reviewed them."
- "Is all the information in your petition true and correct?"If you found errors, tell your attorney before the meeting so amendments can be filed.
- "Have you listed all of your assets?"This includes everything: bank accounts, vehicles, real estate, personal property, expected tax refunds, and pending lawsuits.
- "Have you listed all of your debts?"
- "Have you transferred, sold, or given away any property in the last 2 years?"Includes gifts to family, selling a car below market value, or transferring property.
- "Are you expecting any inheritance within the next 180 days?"
- "Do you owe any domestic support obligations (child support/alimony)?"
- "Have you filed all required tax returns for the past 4 years?"
- "Is there anything you want to change or correct in your petition?"
- "Do you have any questions about the bankruptcy process?"
Tip: Keep answers short. "Yes." "No." "I don't recall the exact amount, but it is listed on Schedule B." Do not volunteer extra information.
What to Wear
- Business casual clothing (khakis/slacks, collared shirt, blouse)The 341 meeting is held in a conference room, not a courtroom. Suits are not required.
- Clean, neat appearance
- Comfortable shoes (you may wait 30-60 minutes)
Avoid
- Flashy or expensive jewelry
- Designer clothing or accessories with visible logos
- Anything suggesting financial comfort (luxury watches, designer bags)
- Overly casual clothing (shorts, flip-flops, tank tops)
What NOT to Say
These are common mistakes that can complicate your case or raise red flags with the trustee.
- Do NOT volunteer information beyond what is askedAnswer the question. Stop. Do not explain, justify, or add context unless the trustee asks for it.
- Do NOT say "I forgot to list..." or "I didn't include..."If something is missing, tell your attorney before the meeting and file an amendment. Do not announce omissions to the trustee unprompted.
- Do NOT lie or exaggerate -- you are under oathPerjury in bankruptcy is a federal crime under 18 U.S.C. section 152. It can result in denial of discharge and criminal prosecution.
- Do NOT discuss future income expectations unless asked"I'm expecting a raise" or "I'm about to start a new job" can affect your means test or plan payments.
- Do NOT argue with the trusteeThe trustee is not your adversary. They are conducting a standard review. If you disagree, note it calmly and discuss with your attorney afterward.
- Do NOT discuss your case with other debtors in the waiting areaOther people's meetings are scheduled for the same time slot. Do not share details of your case.
- Do NOT say "my lawyer told me to say..."Answer from your own knowledge. Attorney-client communications are privileged.
Day-of Timeline
Follow this timeline for a smooth 341 meeting experience.
Phone/Video meetings: If your 341 meeting is by phone or video (common since 2020), test your connection beforehand. Use a quiet room. Have all documents accessible on your screen or desk. Dial in 5 minutes early.
After the Meeting
- Provide any additional documents the trustee requestedNote the deadline. Missing it can delay your case or result in a motion to dismiss.
- Complete the financial management course (debtor education)This is the second required course. Must be completed before discharge. Find providers at justice.gov/ust.
- File amendments if any errors were identified
- Continue making Chapter 13 plan payments (if applicable)
- Watch for your discharge order (Chapter 7: ~60 days after meeting)
